Attorney: Teen accused in mother's death was victim himself
GALLATIN, TN (WSMV) -
Defense attorneys seldom talk publicly about what may have prompted a murder, but the Channel 4 I-Team has learned new information about the teenage boy charged with the brutal killing of his mother.
In an exclusive interview, 15-year-old Zachery Davis' lawyer revealed the teen had reported being raped as a child. And, according to his attorney, no one did anything about it.
Attorney Randy Lucas said he firmly believes that if someone had stepped in to help the troubled teen, this murder never would have happened.
Lucas said Davis was only 9 years old when he watched his father die from Lou Gehrig's disease.
Shortly after that, Lucas says Davis' mother moved her two young boys from Bowling Green, KY, to Hendersonville.
And, it's what may have happened to Davis when he was just 10 that his attorney said might have led to his mother's brutal murder with a sledgehammer last month.
Lucas said the teenager reported the rape to investigators after he was arrested for bludgeoning his mother to death while she slept.
According to the police affidavit, at the time of his arrest Davis was found with a letter on him in which he confessed to killing his mom and setting fire to their Hendersonville home, with his brother still inside.
Lucas said he's not allowed to talk about who allegedly raped Davis, but he said the Sumner County Sheriff's Office is now investigating the alleged sexual assault.
Lucas fought hard to have his client tried as a juvenile, but Tuesday the judge disagreed and ruled Davis will be tried for murder, attempted murder and arson as an adult.
The Channel 4 I-Team called the Sumner County Sheriff's Office about those accusations and was told they can't comment or even confirm whether or not there is an investigation, because it involves claims of a child being sexually abused.
A spokesman for Sumner County Schools said if there was ever an accusation of sexual assault or a crime being committed against a student they would report it to police.
